Welcome to Island Spirit Photography! These Terms of Service (“Terms”) govern your access to and use of our website and services provided via the Pixieset platform (“the Site”), including the purchase, download, and use of my digital and/or physical photographic works.
By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
You may browse, view, and purchase photographic works for personal or commercial use, as specified in the license terms associated with each image. You agree not to:
Copy, reproduce, or redistribute any content without written permission.
Use any content in a way that infringes on copyright or intellectual property rights.
Attempt to reverse-engineer or tamper with the Site’s functionality.
2. Purchases & Payments
All prices are listed in AUD and include GST (if applicable). Transactions are processed securely through Pixieset’s integrated payment system. By placing an order, you agree to:
Provide accurate billing and shipping information.
Pay the total amount for the selected product(s).
Understand that digital downloads are non-refundable once delivered.
3. Licensing & Usage
When you purchase a digital photo, you are granted a non-exclusive, non-transferable license to use the image for personal or agreed commercial purposes. You may not resell, edit (beyond cropping or display adjustments), or distribute the image without express written permission.
If you’re unsure whether your intended use is permitted, please contact us before use.
4. Delivery
Digital Products: Delivered via secure download links after payment confirmation.
Print Products: Shipped to your provided address within the estimated delivery window shown at checkout.
We are not responsible for shipping delays due to carrier issues or incorrect addresses.
5. Refunds & Returns
Digital Downloads: All sales are final. No refunds for digital content once the download link has been delivered.
Print Orders: Refunds or replacements are provided only for damaged, defective, or incorrect items. Please contact us within 7 days of receipt with photo evidence.
6. Intellectual Property
All images, designs, and content on this Site are the intellectual property of Island Spirit Photography and are protected by Australian and international copyright laws. Unauthorized use is strictly prohibited.
7. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how your data is collected and used.
8. Platform Disclaimer
This website is powered by Pixieset, which provides hosting and e-commerce functionality. We are not responsible for any outages, bugs, or third-party service interruptions on Pixieset’s platform, though we will work to resolve any issues that affect your experience.
